Terms of Service

1. Agreement to Terms

By accessing or using ROCK.SCOT — including our website, radio stream, merch store, or advertising services — you agree to be bound by these Terms of Service and all applicable laws. If you do not agree, do not use our services.

These terms are governed by the law of Scotland. Any disputes will be subject to the exclusive jurisdiction of the Scottish courts.

2. Our Services

ROCK.SCOT provides:

• DAB+ Radio Broadcasting — 24/7 rock music station across West Scotland
• Online Streaming — live audio stream at rockdotscot.com
• Merch Store — print-on-demand merchandise at rockdotscot.com/merch.html
• Advertising Services — commercial airtime and sponsorship packages
• Mailing List — opt-in newsletter and station updates
• Listener Messaging — send requests and shout-outs to on-air presenters

3. Merch Store

3.1 Products and Fulfilment

All merchandise sold through ROCK.SCOT is custom print-on-demand, manufactured to your specific order by our fulfilment partner Gelato AS. Products are not held in stock — they are made when you order them.

Estimated timescales from payment confirmation:

• Print and dispatch: 3–5 business days
• UK delivery: 5–7 business days
• International delivery: 7–14 business days

3.2 Right to Cancel — Custom Goods Exception

3.3 Returns and Refunds

We will replace or refund items that are:

• Faulty or damaged on arrival
• Significantly different from the product description
• Printed with a manufacturing defect

To report a problem, email studio@rock.scot within 30 days of delivery with your order reference and a photo of the issue. We will arrange a replacement or refund within 5 business days of confirmation.

We do not accept returns for: change of mind • incorrect size selected (please check our size guide before ordering) • general dissatisfaction with print-on-demand quality where the product matches its description.

3.4 Pricing and VAT

All prices shown include UK VAT at 20%. A VAT receipt is available on request. Delivery costs (if applicable) are shown at checkout before payment is taken.

3.5 Payment

Payments are processed by Stripe Inc., a PCI DSS Level 1 compliant payment processor. We never see, store, or handle your card details. Payment is taken at the time of order. We accept major credit and debit cards.

3.6 Order Confirmation

You will receive an order confirmation email after payment. This constitutes acceptance of your order and forms a contract between you and Caledonia TX Ltd. If we are unable to fulfil your order for any reason, we will notify you and issue a full refund within 5 business days.

4. Broadcasting and Streaming

4.1 Licences

ROCK.SCOT operates under licences from:

• Ofcom — DAB+ digital radio broadcasting licence
• PRS for Music — musical composition performance rights
• PPL (Phonographic Performance Limited) — sound recording rights

4.2 Your Licence to Listen

We grant you a personal, non-exclusive, non-transferable licence to listen to our broadcasts and stream for private, non-commercial use only. You may not:

• Record, redistribute, or rebroadcast our content without written permission
• Use our stream in a commercial setting (e.g. in a shop or bar) without a separate licence
• Attempt to extract or download audio content
• Use automated tools to access our stream

4.3 Service Availability

We aim for 24/7 broadcasting but do not guarantee uninterrupted service. We are not liable for losses arising from service interruptions due to technical faults, maintenance, transmitter issues, or events outside our control.

5. Listener Messages

When you use our "Message the DJ" feature, you agree that your message:

• Will be moderated before or after delivery
• Must not contain threatening, abusive, discriminatory, or illegal content
• May be read on-air at the presenter's discretion (without identifying you unless you choose)
• If flagged as threatening, may be retained and disclosed to Police Scotland

Messages sent during automation (no live presenter) are saved and made available to the next scheduled presenter.

6. Advertising Services

6.1 Booking and Payment

• All prices quoted are exclusive of VAT (20% added)
• Campaigns require minimum 14 days notice; standard rate requires 27 days
• Payment is required in advance unless credit terms are agreed in writing
• Campaigns are confirmed only upon receipt of payment and written confirmation from us

6.2 Cancellation

• Cancellation with more than 48 hours notice: full refund less 10% administration fee
• Cancellation within 48 hours: no refund
• We reserve the right to cancel campaigns that breach advertising standards, with a full refund

6.3 Standards

All advertisements must comply with: the BCAP Code • Ofcom advertising and sponsorship rules • ASA regulations • must be legal, decent, honest and truthful.

6.4 Make-Good

If we fail to broadcast your advertisement as agreed, we will provide equivalent replacement airtime or a pro-rata refund. We are not liable for consequential losses.

7. Intellectual Property

All ROCK.SCOT branding, logos, website design, and original content are owned by Caledonia TX Ltd. All rights reserved. Music broadcast is licensed through PRS for Music and PPL. Unauthorised recording or redistribution of our broadcasts violates UK copyright law.

8. Acceptable Use

You must not use our services to:

• Harass, threaten, or abuse any person
• Transmit spam, malware, or harmful code
• Violate any applicable law or regulation
• Interfere with or disrupt our technical systems
• Impersonate ROCK.SCOT, our staff, or presenters

We reserve the right to block access for any user who breaches these terms without notice or refund.

9. Limitation of Liability

To the fullest extent permitted by law, Caledonia TX Ltd shall not be liable for indirect, incidental, consequential, or special damages arising from use of our services. Our total liability to you in respect of any claim shall not exceed the amount paid by you to us in the 12 months preceding the claim.

Nothing in these terms limits our liability for: death or personal injury caused by our negligence • fraud or fraudulent misrepresentation • any liability that cannot be excluded under Scots law.

10. Data Protection

Your use of our services is subject to our Privacy Policy, which explains how we collect, process, and protect your personal data under UK GDPR and PECR.

11. Changes to Terms

We may update these terms from time to time. The "Last updated" date at the top reflects the current version. Continued use of our services after changes constitutes acceptance of the updated terms.
